Not for Profit or Charitable Organisation Development Applications

Not for Profit Club, Community Group or Charitable Organisations Application Fee Waivers - Council Owned Land

If you are a registered Not for Profit Club, Community Group or Charitable Organisation you may seek a Fee Waiver for the Council Development Applications fees if the Development Application is on Council owned land. If the Application type is not a DA the NSW Planning Portal Fees may still apply for some Application types, and these fees cannot be waived.

To apply for a waiver of the Council fees, the request must be made in cover-letter and the following criteria must be met:

a. The approved project is on Council owned or controlled land.

b. The applicant is a not-for-profit club, organisation, community group or charitable organisation and is in effective control of the subject land.

c. A request to waive development application fee is made in writing to Council and sets out the community benefit that will be achieved from the development.

d. This request must be uploaded to NSW Planning Portal along with the other documents submitted with the application.

Not for Profit Club, Community Group or Charitable Organisations Application Fee Waivers - Not on Council Owned Land

In the case of a registered Not for Profit Club, Community Group or Charitable Organisation seeking a Fee Waiver for the Council Development Applications fees if the Development Application that is NOT on Council owned land. A Fee Waiver is NOT applicable.

In this case, a request can be made for a Refund of the Council Development Application fees. This request must be made to Council after the application has been accepted and lodged following the fee payment. Please note that some application types may still attract a NSW Planning Portal Fees which cannot be refunded.

The request must be a formal request in writing sent via email to mail@wsc.nsw.gov.au and addressed to the Manager Development Assessment and Regulation to seek a refund of any of the Council fees paid. This request must also set out the community benefit that will be achieved by the Development.
