Proactive Release Information
Mandatory proactive release of Open Access information

Under the Government Information (Public Access) Act 2009 (GIPA Act), Council is required to make the government information that is deemed open access information publicly available unless there is an overriding public interest against disclosure of the information. Section 6(2) of the GIPA Act provides that:

Open access information is to be made publicly available free of charge on a website maintained by the agency (unless to do so would impose unreasonable additional costs on the agency) and can be made publicly available in any other way that the agency considers appropriate.

Council’s Proactive Release of Information Register includes hyper-links that provide you with direct access to much of this information and details how you can access open access information that is not published on the website, where Council has determined that publishing the information online would impose unreasonable additional costs to Council.

If the open access information you are seeking has not been published on Council’s website, you may request access to the information by contacting Council.

In addition to open access information, Council is also authorised to make any government information that it holds pro-actively available to the public unless there is an overriding public interest against disclosure of the information. This is a discretionary authority to release information in any manner considered appropriate, free of charge or at the lowest reasonable cost. The Proactive Release of Information Register therefore also includes information that Council has decided is in the public interest to make available without imposing unreasonable additional costs on Council.

Note: Council encourages members of the public to contact Council with suggestions for information which it can consider for authorised proactive release.
